Options:

  • Lawyer files motion to withdraw
  • Terminate lawyer and inform the court
  • 'he prudent thing to do would be to file the consent to change counsel form'
  • If attorney doesn't respond, you are paying for it: judge orders the attorney to explain himself in court, and you get to foot the bill
    • You must notify attorney of your desire for 'consent to change attorney'. One person delivered it to attorney, without proof (signature of doing so) - and attorney said he never received the form.
  • Verbal= ore tenus. No ore tenus motions to withdraw. Must be in writing.
  • consent to change attorney form needs to be filed with the Clerk's office and served on the opposing side
