Discourage litigation. Nominal winner is often the real loser.

There are 1.3M lawyers in the USA [1]
In majority of cases, both lawyers get paid more than winner recovers.
Court doesn't solve problems. It finds the 'truth.' That may be expensive or not solve anything of substance in many cases.
